Federal Court Requires HHS to Eliminate Medicare Appeals Backlog by 2020

A D.C. federal judge is refusing to rescind an order requiring the Department of Health and Human Services (HHS) to clear a huge Medicare appeals backlog, despite the government’s claims that meritless claims will inevitably be paid. Recall that in early December, the same judge granted summary judgment to the American Hospital Association (AHA), requiring HHs to eliminate the current backlog by 2020 (AHA v Burwell).
