FCA Penalties Increase

The U.S. Department of Justice (DOJ) has released an interim final rule announcing that it will increase the minimum per-claim penalty under the False Claims Act (FCA) from $5,500 to $10,781, and the maximum per-claim penalty from $11,000 to $21,563. These adjusted amounts apply only to civil money penalties (CMPs) assessed after August 1, 2016, and where violations occurred after November 2, 2015. As background, this announcement has been expected ever since the Railroad Retirement Board updated FCA penalties in accordance with the passage of the Bipartisan Budget Act of 2015.
