HHS Proposed Rule Expands Definition of Discrimination

The Department of Health and Human Services issued a proposed rule last week to “advance health equity and reduce disparities in health care. According to HHS, the proposed rule will assist some of the populations that have been most vulnerable to discrimination and will help provide those populations equal access to health care and health care coverage.

 The proposed rule impacts section 1557 of the Affordable Care Act (ACA) and establishes that the prohibition on sex discrimination includes discrimination based on gender identity. It also includes requirements for effective communication for individuals with disabilities and enhanced language assistance for people with limited English proficiency. Comments on the proposal are due November 9, 2015.
