US Supreme Court Hears ACA Case

Dianne De La Mare

On March 4, 2015, the US Supreme Court heard oral arguments in King v Burwell, a legal challenge to the tax credits in the 2010 Affordable Care Act (ACA). The outcome of this litigation will shape the future of the current law.

During oral argument, the justices appeared divided, with observers citing Chief Justice John Roberts and Justice Anthony Kennedy as the justices most likely to decide the future of the health care law. Justice Roberts asked only a few questions in oral argument, while Justice Kennedy asked a lot of questions and suggested the challenge to the tax subsidies may face a “serious constitutional challenge.”
